On October 1, the Assembly Committee on Agriculture held a public hearing on Assembly Bill 206 which relates to hemp regulation. Rob Richard from the Wisconsin Hemp Alliance addressed questions from the Committee on if the trace amounts of THC in legal CBD products would show up on a toxicology test. Questions around this concern arose from a recent Senate Committee hearing on an amendment for Senate Bill 188 which set the OWI provisions for THC levels under 1 nanogram per milliliter. Richard asked Amy Miles, Forensic Toxicologist from the state’s Hygiene Lab, if the Delta 9 THC from a legal CBD product he took would show up in a toxicology report, and her response was no. “The Delta 9 THC metabolizes so quickly that it will not remain in your system, or even if it does remain in your system, it will not exceed a level that would put me over 1 nanogram per milliliter.”
