CHATTANOOGA, Tenn. — 

The Tennessee Bureau of Investigation (TBI) has announced agents will be using different testing methods to determine the difference between hemp, which is legal, and marijuana.

In a news release posted on its website, TBI says it will stop testing if someone is caught with less than a half ounce of marijuana, which is only a misdemeanor charge.

Chattanooga attorney Bill Speak says TBI’s testing can be expensive and labor-intensive.

If someone has more than half an ounce, TBI will test the ratio of THC to CBD. If the new test shows a pink color, it is hemp. If the test comes back blue, it is marijuana.

Any tests showing marijuana will be sent for more testing to see if it is above the legal THC limit.

“It makes it practically impossible to prosecute someone unless they get the TBI to go ahead and perform the test of they send it to an independent lab for testing,” Speak told us.

The TBI can still test instances of less than a half ounce if ant District Attorney requests it.
